[Contracts] IP High Court, Reiwa 6 (Ne) 10058 [Development of green-laver seeding technology using a waterwheel] <Presiding Judge Hibiku Shimizu>

1. Whether the joint research agreement was breached (unauthorized publication of research results)

The idea itself of using a waterwheel to seed green laver had existed since 1998, before the joint research.

The joint research sought to clarify specific seeding conditions and other matters. The publication merely indicated that “attachment using a waterwheel-type seeding apparatus is possible” and did not disclose specific technical details, such as suitable circumstances or conditions.

The idea itself was a premise of the joint research, not its result. The publication therefore did not constitute publication of “research results,” and no breach of contract was found.

2. Whether patent acquisition was obstructed

Since the idea of waterwheel seeding of green laver was itself well known, merely stating that it “became possible” would not secure a patent. Disclosure of specific technical details was necessary to obtain a patent, regardless of the publication.

Accordingly, even though the publication was cited during patent examination, it was not found to have obstructed the plaintiff's patent acquisition and did not constitute non-performance of an obligation.
