Osaka District Court, Reiwa 6 (Wa) 6010 [Network boot system] <Presiding Judge Matsuami>

The defendant's product does not satisfy “when a write request signal is received for the read cache area ... control is performed so that the cache data for that area is not used (= subsequent reading is also prohibited).”

(In the defendant's product, even when existing data is updated, the data before the update (existing data) is preserved as it is for purposes such as version management and environment restoration.)

* The doctrine of equivalents also does not apply (first requirement: non-essential part).

(Excerpts from the judgment — English translation)

“Control is performed so that it is not used” literally means that the area is not used, and therefore the data present in that area will not be read. ...

In the defendant's product, when existing data is updated, the existing data is preserved as it is, while the updated data is stored in a free block, and the values in the mapping table are thereafter changed. Thus, after a write request signal is received, the updated data is used. However, the defendant's product provides functions for switching between multiple environments and for version management ......, and it is understood that, to implement such functions, it is necessary to have a configuration that uses the updated data while retaining the data before the update, in order to restore the environment in which that data was used. Accordingly, when, after a write request signal is received, the data before the update remains and the updated data is used, the fact that the data before the update is not used does not establish that subsequent reading of that data is also prohibited.
