[Trademarks] IP High Court, Reiwa 6 (Gyo-Ke) No. 10071 — “Taishoken” (Judge Miyasaka)

*An implied agreement granting a non-exclusive trademark license requires objectively verifiable, clear and affirmative intent to confer a right, going beyond mere acquiescence.

→ Cancellation for non-use.

(Excerpt from the judgment, translated)

Even if a trademark owner has shown tolerance of a third party’s use of a mark identical to the registered mark, an implied agreement granting a royalty-free non-exclusive license should not readily be inferred from that alone. A non-exclusive license is a right to use the registered mark for the designated goods or services (Trademark Act Article 31(2)). It may be transferred with the trademark owner’s consent or through inheritance or other general succession (paragraph 3), and, if registered, it may be asserted against persons subsequently acquiring the trademark right or an exclusive license relating to that right (paragraph 4). Given this proprietary character, establishing an implied agreement to grant a non-exclusive license requires objectively verifiable, clear and affirmative intent to confer a right, beyond mere “acquiescence.”
