Article / Copyright — “Identifying the Author of a Compilation” (Katsuyuki Izumi, Intellectual Property Law and Policy Journal, Vol. 42 (2013))
A compilation work = one “that is creative by reason of the selection or arrangement of its materials” (Article 12(1) of the Copyright Act).
Author of a compilation work = a person who was creatively and substantively involved in the selection or arrangement of the materials.
A person who decided the editorial policy can also be the copyright holder of a compilation work. (Tokyo District Court, September 17, 1980, “Chi no Sazamegoto” case.)
The person who commissioned creation of the work or supplied the original proposal can also be the copyright holder of a compilation work. (Osaka District Court, March 29, 1985, “Commercial Advertisement” case.)
