Reiwa 6 (Ne) 10038 [Motorcycle brake control device] <Presiding Judge Honda>
Since the specification consistently states “angular velocity,” correction (reinterpretation) as a clerical error to “angular acceleration” is not permitted.
⇒ The claimed invention (including a physically contradictory formula) cannot be said to be described in the detailed description of the invention, and violates the support requirement.
(Judgment excerpt — English translation)
“The appellant argues, regarding Formula A, ‘Ghosei = Gken − (Ψ · Rhsen),’ that if Ψ is understood in its usual symbolic meaning, the formula subtracts a value having the dimension of velocity—angular velocity multiplied by sensor mounting height—from Gken, which has the dimension of acceleration, making it physically meaningless; thus, ‘Ψ · Rhsen’ cannot be understood literally as multiplying angular velocity by sensor mounting height. The appellant further argues that it is nevertheless clear that ‘Ψ · Rhsen,’ the correction term for lateral G (Gken) in Formula A, is a correction term for removing the velocity change along a circular trajectory superimposed on Gken, in other words, circumferential acceleration. However, … physical meaninglessness does not itself establish a clerical error, and Formula A is as stated above; the appellant's argument therefore cannot be accepted.”
