“… In Example 5 (Table 12) of Reference 2, … the amount of omega-6 falls within the range of 1–35 g. …
In view of the disclosed range of 1–35 g in Table 12 of Reference 2, discussed above in section (a), concerning the omega-6 fatty acid dose in the composition of Cited Invention 2 containing optimal daily amounts of fatty acids, adopting the dose of ‘1–40 g of omega-6 fatty acids in an average daily amount’ in the claimed composition was something a person skilled in the art could appropriately have done.
… Reference 2 states that nuts and seeds constituting its components contain antioxidants and polyphenols. Since it can be said to have been well known before the claimed priority date that polyphenols are antioxidants, including polyphenols as antioxidants in the composition of Cited Invention 2 was also something a person skilled in the art could appropriately have done. …”
