IP High Court, Reiwa 5 (Ne) 10063 [Electric impact fastening tool] <Presiding Judge Hibiku Shimizu>

Inventive step denied.

<Difference A>

The invention uses an outer-rotor electric motor, whereas the invention in Exhibit Otsu 15 uses an inner-rotor motor.

<Difference B>

In the claimed invention, magnets are affixed with gaps on the outer peripheral side of the stator. Exhibit Otsu 15 does not expressly disclose the magnet-retention arrangement.

1. Obviousness of difference A (outer rotor)

Increasing output torque and reducing size and weight were general problems in this technical field.

Exhibit Otsu 6 also states that outer-rotor motors for electric hand tools favor higher torque.

⇒ Applying invention A in Exhibit Otsu 6, from the same technical field, to solve the problem of Exhibit Otsu 15 and replacing its inner rotor with an outer rotor was readily conceivable.

2. Obviousness of difference B (magnet fixation)

Affixing magnets to a rotor with adhesive and gaps between them was well known at the priority date.
