IP High Court, Reiwa 5 (Gyo-Ke) 10104 [Device formed from a very low resistance material…] <Judge Hibiku Shimizu>

⇒ Enablement requirement not satisfied.

The test results in the specification (Figures 14A–21B) show resistance decreasing as temperature falls, but none shows resistance reaching zero.

Resistance and resistivity must be distinguished. With nonzero resistance, the material cannot be said to be superconducting.

Even assuming that part of it became superconducting, no concrete method is disclosed for extracting only that part to form a conductor.

⇒ Regarding the Josephson effect, the specification's assertion that Josephson current flows through a barrier material despite the conductor not being superconducting (zero resistance) contradicts common technical knowledge.

The specification contains no test results supporting such a phenomenon, and the plaintiff's affidavit supplies no concrete basis either.
