IP High Court, Reiwa 5 (Gyo-Ke) 10100 [Hand-pushing member] <Presiding Judge Hibiku Shimizu>
Ko 8 is attached to the curved portion of a cart's U-shaped handle and prevents the hand from slipping onto the vertical pipe.
⇒ Its shape and dimensions assume attachment to that curve. There is no motivation to attach it to a single vertical rod as in the patent at issue.
There is no motivation to deliberately make Ko 9 an integrated structure that is harder to manufacture and through which the pipe passes, as claimed.
⇒ Inventive step affirmed.
