IP High Court, Reiwa 6 (Ne) 10033 [Eaves] <Presiding Judge Nakahira>

* Appeal dismissed: Claim elements not satisfied.

The invention features a vertical plate portion of the front-edge plate attached to the eaves' front end. It abuts the open front-end surface of the eaves plate, and its front surface guides rainwater downward (element B2).

This eliminates the conventional rain gutter and makes the eaves smaller and simpler.

⇒ No literal infringement.

Under the claim wording, the vertical plate portion is an up-and-down plate section distinct from the horizontal plate portion, and its front surface must serve as the guide surface.

The corresponding portion of the defendant's product is U-shaped and includes a horizontally extending part, so it does not fit this definition.

Its guide surface and abutting portion are also separated, projecting farther forward. That is inconsistent with the invention's purpose of making the eaves compact.

Infringement under the doctrine of equivalents was also denied.
