Claims for procedures to register the transfer of German and Chinese patent rights

⇒ Dismissed as inadmissible.

Actions concerning patent registration fall within the exclusive jurisdiction of the courts of the “place where registration should be made (that country).” Japanese courts have no jurisdiction.

(China) Because there is no reciprocal guarantee of recognition of judgments between Japan and China, even if a Japanese court confirms that “the plaintiff has the rights,” this would not serve to prevent the effects of the judgment in China in favor of the defendant, and would not eliminate uncertainty concerning the plaintiff's legal position.

(Germany) No concrete possibility that the plaintiff's side will conduct business in Germany has been shown, and the legal dispute has not matured.

(Risk of an action in Japan) Even if the defendant brought an action in Japan on the ground of “infringement of a foreign patent,” the possibility that the claim would be upheld would be extremely small because of the territoriality principle.
