Tokyo District Court, Reiwa 5 (Wa) 70393 [Foldable and stowable temporary protective fence] <Judge Nakashima>
* The problem was to reduce weight and make the structure more compact.
⇒ A “pivoting plate-shaped member” is a thin, plate-like member and does not include a circular pipe or rectangular tube.
(Excerpt from the judgment, translated)
Considering the term “plate-shaped” in the “pivoting plate-shaped member” recited in the claim elements, that member solves the problems addressed by the inventions by making the pivoting member plate-shaped and thereby reducing its thickness in the transverse direction of the base frame (H-section steel). It is therefore properly construed as a thin, plate-like member that does not include a circular pipe or rectangular tube.
The defendant's product uses a rectangular tube as the structure corresponding to the “pivoting plate-shaped member.” It therefore cannot be found to satisfy that element.
