Osaka High Court, Heisei 11 (Ne) No. 18 — Method of attaching a filter to an exhaust outlet

*For a product sold as a set, the “exclusively” requirement is assessed for the set as a whole.

(Excerpt from the judgment, translated)

Product 1 is sold as an integrated set comprising a range-hood filter and a protruding case containing a magnet, together with installation instructions. Purchasers of such sets buy them to use the components together, rather than to use each component separately.

Accordingly, in examining whether a set is an article “used exclusively for working” the invention—whether it has other uses—the economic, commercial and practical possibilities of using the set as a whole should be considered. Even if the filter and the protruding case containing a magnet can each be used independently, no use of the entire set other than working Invention ① can be contemplated. Product 1 is therefore an article used exclusively for working Invention ①.
