IP High Court, Reiwa 6 (Ne) No. 10019 — Rolling device (Judge Miyasaka)
*The appellate court rejected the narrow construction adopted below (Tokyo District Court, Reiwa 4 (Wa) No. 18830), but found that another claim limitation was not met.

(Excerpt from the judgment, translated)
The appellee’s products are angular-contact ball bearings used with preload that elastically deforms the balls and inner and outer rings, eliminating gaps between the balls and the inner- and outer-ring raceway grooves. Accordingly, the products do not have “a rolling element contacting only one of the raceway grooves” and cannot be said to “form an unloaded region.”
