Tokyo District Court, Reiwa 5 (Wa) No. 70178 — Zinc acetate hydrate tablets (Judge Nakajima)
*The claim was held not to be satisfied unless the temperature remained within the numerical range until the end of the drying process.
(Excerpt from the judgment, translated)
The marketing approval document for the defendant’s pharmaceutical product states that “the product temperature at the drying endpoint shall be no higher than <50°C>.” Each manufacturing instruction and record for that product instructs that drying end at a product temperature of 41.0°C or higher. It is therefore recognized that, in the defendant’s method, the product temperature reaches 41°C or higher in the “step of drying to obtain granules.” The “step of drying to obtain granules” means the entire drying process. Accordingly, the defendant’s method cannot be said to satisfy the limitation that “the product temperature is below 40°C” in the “step of drying to obtain granules.”
