2019 (Gyo-Ke) 10015 <Tsuruoka>
*A “disclaimer claim” was held to add new matter!!
From the specification's … descriptions … one cannot discern a correlation between heat-treatment time and bringing the zero-crossing time closer to zero seconds while suppressing whisker growth … less than 2.30 seconds … is not … self-evident.
[Claim 3] … A tab terminal for an electrolytic capacitor, comprising … in the welded portion between the lead wire and said aluminum core wire (excluding, however, tab terminals for electrolytic capacitors having a zero-crossing time of 2.50 seconds or more as measured in accordance with JIS C-0053, solderability testing method (wetting balance method)).
(Excerpt from the court's reasoning)
…The specification … contains no express description of a tab terminal having a zero-crossing time of at least zero seconds and less than 2.30 seconds. …Because the specification does not disclose a correlation between heat-treatment time and bringing the zero-crossing time closer to zero seconds while suppressing whisker growth, …it is not self-evident … to suppress whisker generation while setting the zero-crossing time to at least zero seconds and less than 2.30 seconds.
Translator’s notes (editorial)
The source quotes 2.50 seconds in the claim but discusses 2.30 seconds in its commentary and judgment excerpt; the discrepancy is preserved.
