2023 (Ne) 10093, “Copyright Owner of a Cinematographic Work” <Shoji>
*Note that even when the film producer acquires copyright under Copyright Act Article 29(1), the author still holds moral rights!!
The appellee published online an animated video (a cinematographic work) created by the appellant without indicating the author's name.
Because the appellant alone creatively contributed to the overall formation of the video, the appellant is its author.
On the other hand, the appellee, as film producer, initiated and supervised production and bore the legal rights and obligations and the economic risk. Copyright (economic rights) therefore belongs to the appellee under Copyright Act Article 29(1).
However, the appellant holds the right of attribution as an author's moral right, so that right (a moral right) was infringed.
