Tokyo District Court, 2020 (Wa) 29523 [Heat-Shielding Structure Using Uneven Material] <Kokubu>
*Acting as the substantive point of contact ⇒ Aiding established
“AA posted examples of heat-shielding sheet installation on its website and induced BB to request the work at issue…. …AA's representative … had been informed by the defendant of the specific method of installing the heat-shielding sheets….”
(Excerpt from the court's reasoning)
AA posted examples of heat-shielding sheet installation on its website, induced BB to request the work at issue, and entered into a construction contract with BB. It can therefore be said to have been the substantive point of contact for that work in relation to BB as the client. Moreover, AA's representative not only visited the construction site with the defendant's representative to confirm the scope of the work, but had also been informed by the defendant of the specific method of installing the heat-shielding sheets. AA can therefore be assessed as having performed the administrative tasks required for smooth execution of the work while recognizing that the defendant's heat-shielding structure would be created by that work. …It is appropriate to find that AA at least aided the conduct.
