2022 (Gyo-Ke) 10011 [Electrical Device Formed from Very Low Resistance Material] <Shoji>
Obtaining the Josephson effect at resistivity within the claimed numerical range contradicts common general technical knowledge at filing.
⇒ The specification or other application documents must contain test results or the like substantiating that such a phenomenon can occur.
⇒ Enablement requirement: not satisfied
(Excerpt from the court's reasoning)
“…Given that it was common general technical knowledge at the original filing date that a Josephson junction uses two conductors that are superconductors, obtaining the Josephson effect with resistivity in the above range even when the conductor's resistance is not zero is a phenomenon contrary to that knowledge. Accordingly, unless the specification and other application documents describe test results or the like substantiating that such a phenomenon can occur, a person skilled in the art would not recognize that the claimed inventions can be practiced….”
