2023 (Gyo-Ke) 10011 [Device for Remotely Operating a Mobile Terminal] <Miyasaka>

*Disclaimer claim: inventive step not satisfied

The claim was amended to read “images displayed on a mobile terminal (excluding images captured by a camera).”

⇒ A matter stated in an independent claim of the cited reference was excluded as an “essential feature of the cited invention,” but the argument was rejected.

(Excerpt from the court's reasoning)

Regarding Difference 2 (the images displayed in the cited invention are captured by a camera), the plaintiff argues that “image capture” of the display screen of the terminal display unit is an essential feature of the cited invention and there is no motivation to replace it.

However, nothing in Cited Reference 1 (Exhibit Ko 1) suggests that “image capture,” namely capturing images with a camera, is an essential feature of the cited invention.

Further, according to Cited Reference 2 (Exhibit Ko 2), cited by the JPO decision, and the examples of well-known technology added by the defendant in this action (Exhibits Otsu 1 and 2), as of the application's priority date, miracast—a technology using wireless communication to display images shown on the screen of a mobile terminal such as a smartphone on another device's screen—was widely used in smartphones as a standard in android 4.2. It is also found that outputting smartphone screens via miracast to in-vehicle monitors or car-navigation screens was routinely done. The significance of the “image capture unit 252” in the cited invention is that “by displaying the display screen of the mobile terminal 110 captured by the image capture unit 252 directly on the device display unit 258, the user can recognize the display screen of the mobile terminal 110 as it is” (Exhibit Ko 1, [0081]). In terms of the function of “displaying the display screen of the mobile terminal 110 directly on the device display unit 258,” namely the effect of “enabling the user to recognize the display screen of the mobile terminal 110 as it is,” the “image capture unit 252” and the above technologies such as miracast can be said to have this in common.

Accordingly, using well-known technology such as miracast in place of the “image capture unit 252” in the cited invention to provide a configuration having “a display unit (22) displaying images displayed on a mobile terminal (excluding images captured by a camera),” namely the configuration relating to Difference 2, is something a person skilled in the art could readily have conceived.
