The photographs were used on a website introducing affiliated talent to show that affiliation and supplement information about the individuals.
⇒ They were not used as goods or the like, to differentiate goods or the like, or as advertisements for goods or the like.
⇒ No infringement of the right of publicity
In prior litigation, the talent whose exclusive contract had been terminated disputed their contractual status, and the agency continued displaying the photographs until the judgment against the talent became final.
⇒ At least, the limit of tolerability had not been reached; therefore, there was also no infringement of portrait rights.
