2022 (Gyo-Ke) 10057 and 10054 [Lamp] <Honda>

In light of the common general technical knowledge that residuals exist between a linear approximation and measured data, a person skilled in the art can understand that even samples falling slightly short of the stated effect in the specification provide “approximately the desired” luminance uniformity and can solve the invention's problem.

⇒ Support requirement: satisfied

(Excerpts from the court's reasoning)

A person skilled in the art encountering the specification would recognize that …if the parameter satisfies 1.09 < y/x, the problem of suppressing graininess can be solved. On the other hand, the parameter in each invention defined by the corrected claims appropriately specifies lower and upper limits of y/x within 1.09 < y/x, and further specifies ranges of x (claims 5–8). Thus, it can be understood that the …inventions define a range in which luminance uniformity is approximately 85% or higher. …

The plaintiff argues that a person skilled in the art could not recognize from the experimental results that the problem can be solved, because Figure 7A includes samples …whose luminance uniformity does not reach 85% at y = 1.09x. However, …a person skilled in the art understands the inventions in light of the common general technical knowledge at filing that residuals exist between a linear approximation and measured data. Regarding samples 10, 13, and the like identified by the plaintiff, that knowledge permits understanding that approximately the desired luminance uniformity is obtained and the problems of the inventions can be solved.
