2022 (Gyo-Ke) 10039 [Reservation Support Method] <Honda>

*The court identified an “inherent requirement” argued by neither party and found motivation.

⇒ Inventive step: lacking

“To satisfy the inherent requirement, a person skilled in the art would naturally conceive of avoiding a situation in which one continues waiting a long time for a response from the first facility regarding reservation availability.”

(Excerpt from the court's reasoning)

The cited invention and the technology described in Cited Reference 2 belong to the same technical field of facility reservation methods in reservation systems covering multiple facilities. They also share the method of querying a first facility about reservation availability and, if a reply indicating unavailability is received from that facility, extracting other facilities similar to it. …In the cited invention, if the first facility does not send a response about reservation availability for a long time, there is a risk of failing to satisfy the inherent requirement of reserving a facility matching the user's desired conditions before the planned date, or date and time, of use. A person skilled in the art would naturally conceive of avoiding a situation in which one continues waiting a long time for the first facility's response in order to satisfy that inherent requirement. Thus, there is motivation to apply the timeout processing of the technology described in Cited Reference 2 to the cited invention. Applying that timeout processing to the cited invention would result in processing whereby, if no reply is received from the facility terminal within a preset waiting period during which a reply is validly accepted, one or more second facilities other than the first facility are extracted based on the reservation details, and information about those extracted second facilities is sent to the user terminal, just as when the reservation-registration result in the reservation-result information is NG. Accordingly, a person skilled in the art could readily have conceived of the configuration relating to Difference 3 by applying the technology described in Cited Reference 2 to the cited invention.
