2018 (Gyo-Ke) 10094 [System for Characterizing a Stenosis in a Fluid-Filled Vessel] <Mori>

*Even if accurate measurement is not necessarily possible, this is not an issue of clarity (although enablement or support may be at issue)!!

[Claim 1] … A system … comprising a first measurement sensor … taking instantaneous pressure measurements at various locations along said vessel without maximal hyperemic conditions ….

(Excerpts from the court's reasoning)

In the claimed invention, “without maximal hyperemic conditions” means not being in a state in which blood flow has been maximally increased by administering a drug, and “instantaneous pressure measurements” means … measuring the value at an instant …. …Their meanings are unambiguously clear …. …

Certainly, …examining the blood-pressure ratio calculated from those measurements may not necessarily allow the presence or location of a stenosis in a vessel to be accurately identified. Even so, depending on the degree of stenosis and the measurement method, identifying its presence or location cannot be said to be wholly impossible, so the claimed invention cannot be regarded as entirely meaningless. Moreover, although the enablement requirement … or support requirement … might be at issue from that perspective, those matters were not examined in the trial and therefore cannot be examined in this litigation.

Translator’s notes (editorial)

The source has a duplicated negative/typographical wording in its introductory measurement sentence; translated by its meaning in the ensuing quotation.
