[Civil Code/Tort] 2018 (Ne) 10089 <Takabe>

*A seller of predesigned houses sold its own buildings to customers solicited at showgrounds for the appellant's products.

⇒ Tort established (¥1 million in damages per building)

(Excerpt from the court's reasoning)

In the Bigfoot business, customers who visited showgrounds or requested materials were registered in a database and, even if an immediate sale was not possible, were called “stock customers” and cultivated …. The stored customer information had pecuniary value in containing the possibility of future sales of Bigfoot products. From this standpoint, the appellees' sales of their own buildings to those customers reduced or eliminated that possibility and must be regarded as having caused pecuniary damage to the appellant.
