[Article / Agriculture and Fisheries] Protecting and using intellectual property through an IP mix with overseas expansion in view (Agriculture and Fisheries Committee, Patent, January 2026)
1. Branding by vegetable producers
Separate breeders' rights from trademarks: Registered variety names enter the public domain after the protection term, so obtain trademark rights too.
For brands closely linked to a region, strategically distinguish between the GI and regional collective trademark systems.
2. Examples of using an IP mix
① Trademarks × breeders' rights: “Ruby Roman,” and registration of the brand name “Beni Madonna” as a trademark for the variety “Ehime Kashi No. 28.”
② Patents × trademarks: “Flying Pumpkin,” combining a cultivation-method patent with a brand name.
③ Patents × trademarks × GI: “Zentsuji-grown square watermelons,” protected by a cultivation-container patent, a trademark and a GI.
④ Trademarks × GI (overseas): In the Kobe Beef example, the framework for mutual GI protection with Europe and other regions was used to successfully remove false overseas indications based on a Japanese-language GI registration.
3. Geographical indications for alcoholic beverages and know-how management
① Alcoholic beverage GIs: Administered by the National Tax Agency, they protect characteristics of the place of origin (natural and human factors). Established about 20 years before the agricultural GI system, early designations include Iki, Kuma and Ryukyu.
② Know-how management: For technologies such as cultivation techniques whose disclosure through patenting is undesirable, rigorous confidential management as agricultural trade secrets is important.
