* An element that merely changes the number as a result is not “control information.”
⇒ Addition of new matter.
The “change flag” and “threshold” described in the specification are not control information directly intended to change the number of motion-vector candidates. They merely result in a change in that number. Corrections based on them therefore add new matter, contrary to Article 126(5) of the Patent Act.
“There must be a purpose–means relationship with changing the number of motion-vector candidates; an occasional consequential, indirect influence on the number is insufficient.”
“Control information concerning the change flag cannot be understood as intended to change that number. The change flag is therefore not control information for changing the number of motion-vector candidates.”
“Control information concerning threshold Th is involved in changing the vector count, but contributes only consequentially and indirectly; it cannot be understood as intended to change the number of motion-vector candidates.”
Judgment excerpt:
The specification does not expressly define “control information for changing the number of motion-vector candidates.” However, the wording “for” and its technical meaning require a purpose–means relationship with changing that number. Merely having a consequential or indirect influence is insufficient.
Threshold Th contributes only consequentially and indirectly, so it does not qualify as such control information.
