Case No. (2024) Yue 0192 Min Chu 113
The “Ultraman” case
Images generated by entering “Ultraman” as a generative-AI keyword resembled Ultraman.
⇒ The generative-AI service provider was held liable.
<Operative part of the judgment, translated>
... The defendant must cease infringing copyright in the Ultraman series of works and take appropriate technical measures to prevent images infringing the plaintiff's copyright from being generated during users' normal use of the service.
Plus damages of RMB 10,000.
<Reasons>
1. Lack of complaint and reporting functions.
2. Insufficient warnings about potential risks.
3. Breach of the obligation to clearly identify AI-generated content where it could be mistaken for something else.
Cf. Japan's “Chupa Chups” case (trademark rights).
