IP High Court, Reiwa 1 (Gyo-Ke) No. 10103 — Support structure for a concrete foundation (Judge Mori)
*The court defined the problem at a less demanding level.
→ Support requirement satisfied.
(Excerpt from the judgment, translated)
The plaintiff argues that the problem addressed by the invention is “to prevent damage to the pile head even when excessive bearing pressure acts on it”…. However,…whether the invention achieves the effect of preventing damage to the pile head is assessed by comparing the use of pile-head concrete with a design strength higher than that of the foundation concrete against cases without such concrete, when the design strength is set after considering various factors for a particular construction project. The effect is that damage to the pile head becomes less likely than when the claimed configuration is not adopted. The plaintiff’s argument is therefore unfounded.
