Trial and Appeal Practitioners Study Group Report 2024 — Case 3 (Chemistry 2)
[Relationship between requirements for correction of medical-use inventions, particularly new matter, and the enablement and support requirements for the corrected invention]
IP High Court, Reiwa 2 (Gyo-Ke) No. 10135
Addition of new matter concerns “technical ideas disclosed by the specification or drawings.” This is consistent with the support-requirement inquiry that compares the claims with the detailed description and asks whether the claimed invention is an invention described in the detailed description.
Whether something is “substantially disclosed” is distinguished as an area to be assessed under the support requirement: whether it falls within the scope in which a person skilled in the art can recognize, from the detailed description, that the invention’s problem can be solved.
