IP High Court, Reiwa 6 (Gyo-Ke) 10050 [Information processing apparatus] <Presiding Judge Miyasaka>

Patent valid.

<Whether it constitutes an “invention” (utilization of laws of nature)>

The plaintiff argued that processing not including calculation of depreciation costs is abstract, cannot be called concrete information processing using hardware resources, and is merely an artificial arrangement (business rule), rather than an “invention.”

⇒ In the invention, software information processing by the calculation units and the product optimization unit is concretely implemented using computer hardware resources (CPU, memory, etc.).

Even though calculation of depreciation costs is not expressly stated in the claim, it is not excluded, and an embodiment is described in the specification. The invention is therefore recognized as a creation of a technical idea (an invention).
