2021 (Wa) 15964 [Elastoplastic Hysteretic Damper] <Shibata>
*The fact that every example had a feature was one reason for a restrictive interpretation.
“The problem … to be solved … exists where inputs from multiple directions are contemplated…. Every example described in the specification involves … inputs from multiple directions….”
⇒ Claim limitation not satisfied
(Excerpt from the court's reasoning)
…The problems addressed by the inventions arise where inputs from multiple directions, rather than a single direction, are contemplated. The specification describes the above …significance of the inventions, and every example is found to involve inputs from multiple directions that can be accommodated by adopting the configuration of Invention 1. No other part of the specification describes accommodating input from a single direction. From these descriptions and the wording of elements G and H, it is appropriate to construe the damper of Invention 1 as a damper used in portions of structures and the like where inputs from multiple directions are contemplated, receiving inputs from multiple directions at its shear portion and capable of accommodating them.
