2015 (Gyo-Ke) 10095 [Fuel-Consumption Reduction Device for an Internal Combustion Engine] <Shitara>
*It is …common general technical knowledge …that infrared absorption bands for a water-vapor layer also exist in the …wavelength regions.
⇒ Which infrared wavelength absorption band to use to improve engine combustion efficiency is a design matter a person skilled in the art may appropriately select.
(Excerpt from the court's reasoning)
It is …common general technical knowledge in fields using infrared or near-infrared light …that infrared absorption bands for a water-vapor layer exist not only at approximately 2.4–3.4 μm, but also at approximately 1.33–1.5 μm and approximately 1.8–2.0 μm. Thus, which absorption band of infrared light to use to improve engine combustion efficiency (reduce fuel consumption) is a design matter a person skilled in the art aware of that knowledge may appropriately select. A person skilled in the art encountering Cited Reference 1 is also found to have motivation to use an absorption band at approximately 1.33–1.5 μm, namely in the near-infrared region, to improve engine combustion efficiency (reduce fuel consumption).
