Tokyo District Court, 2021 (Wa) 11507 [Compression Supporter] <Nakashima>

*Includes a configuration that cannot solve the problem.

(And that configuration is the defendant's product.)

⇒ Support requirement: not satisfied

(The same structure as the second PCSK9 litigation)

(*The appellate judgment did not decide the support requirement.)

(Excerpt from the court's reasoning)

In the invention at issue, the method of “fixing a low-stretch material to the body” … is understood to encompass, in addition to a so-called separate-material attachment structure …, the integrally knitted/woven structure … adopted by Defendant Product 17 …. However, the specification and other documents contain no statement that a person skilled in the art could solve the invention's problem using a supporter with an integrally knitted/woven structure. On the contrary, paragraph [0002] expressly states that such a supporter cannot apply the necessary pressure to an arbitrary location on the knee joint and cannot solve the invention's problem. Accordingly, in light of the specification and other documents, it cannot be found that, even without a description or suggestion, a person skilled in the art would recognize from the common general technical knowledge at filing that a supporter with an integrally knitted/woven structure could solve the invention's problem.
