2016 (Ne) 10047 [Electrical Connector Assembly] <Takabe>

*The patentee's counterarguments on invalidity and determinations in an action to rescind a trial decision do not bind the court in an infringement action.

(Excerpts from the court's reasoning)

…Determinations in the reasoning of a judgment in an action to rescind a trial decision concerning the same patent do not bind the determination of technical scope in an infringement action.

…When construing the technical scope of a patented invention, a party's arguments made in response to the opposing party's invalidity allegations do not necessarily bind the court. Further, the claims for Patented Invention 2 do not provide the limitation asserted by the appellant …. Nor are the problem and functions and effects of Patented Invention 2 such that they can be achieved only if, whenever the cable connector is tilted upward—that is, before reaching its final mated position—the rearmost position of the rear edge of the locking projection is always forward of the foremost position of the projection extending inward into the locking groove from its rear edge.
