[Unfair Competition Prevention Act / Trade Secrets] Osaka District Court, 2023 (Wa) 12731
*Merely signing a confidentiality undertaking does not automatically establish that information was managed as secret.
(Excerpt from the court's reasoning)
… The plaintiff asserts that the defendant signed the confidentiality undertaking at issue, but that alone does not mean that Information 1 at issue automatically qualifies as “confidential information” or was managed as secret.
Furthermore, … an online form was publicly available through which customers could request a free estimate and agree to a visit for an estimate …. That and a customer's request to a contractor for a site survey are identical in that both involve conducting visiting sales activities in the form of an application from the customer. Thus, Information 1 at issue also lacks non-public status.
