IP High Court, Reiwa 5 (Gyo-Ke) 10062 [Bone anchor with improved fixation strength] <Presiding Judge Shoji>
The claimed “outer surface of the anchor body” means the outer circumference connecting the tops of the ribs, rather than the uneven surface formed by multiple channels and ribs.
⇒ Similarly treating the circumference joining the tops of the bone-engaging surface portions (corresponding to ribs) in the cited invention as its outer surface, the portions between those surfaces correspond to “channels” formed within the outer surface, and the bone-engaging surfaces defined by them correspond to “ribs.”
The claim has channels “intersecting” an eyelet (a hole for passing suture thread) in a T shape.
Providing a through-hole (eyelet) for suture thread in a suture anchor was well known before the priority date.
⇒ Replacing the cited invention's “continuous groove” with the well-known eyelet was readily conceivable by a skilled person. Locating that eyelet in communication with the channel (suture-receiving groove), at a T-shaped intersection without compromising structural integrity, was merely a design choice a skilled person could appropriately adopt.
In Exhibit Ko 1, the recess for accommodating the knot is described only as “preferred,” not indispensable.
⇒ Inventive step denied.
