IP High Court, Reiwa 5 (Gyo-Ke) 10092 [Bag processing machine] <Presiding Judge Honda>
* Violation of the expanded prior-application rule (Patent Act Article 29-2).
1. Identification of the prior application's invention
The earlier specification (paragraph 0046, Figure 3, etc.) shows that filling time T2 is twice the time T1 of the other steps, with two groups filled and closed during that period.
2. Difference 1: Adjustment of transfer speed
The present invention adjusts speed through current to an electromagnet, whereas the prior invention controls it through an electromagnetic coil.
⇒ The earlier specification describes freely setting speed through linear transport. Using the coil as an electromagnet and adjusting speed through current is an inherent premise of that invention.
3. Difference 2: Stocking function
The present invention “stocks” processed bags upstream of the downstream apparatus.
⇒ “Stocking” means keeping them waiting upstream so the downstream apparatus can immediately begin the next processing step.
⇒ In the prior invention, the second group waits upstream (in the third filling region) while the first group is sealed, and can move to sealing immediately afterward. This qualifies as “stocking.”
