* “Oxygen supply means” (element D) was not satisfied.

The defendant's system intentionally and actively adds ozone to the micro/nanobubbles supplied to the second tank (aeration tank).

The patent aims to perform biological treatment by microorganisms in that tank. Because ozone may kill microorganisms, the invention instead addresses early reduction of residual ozone.

Deliberately supplying additional ozone to the tank containing microorganisms runs counter to the invention's purposes—promoting biological treatment and reducing residual ozone—and is incompatible with its technical concept.

⇒ “Oxygen supply means” means supplying oxygen. It does not extend to means that actively supply additional ozone capable of harming microorganisms.
