The decision dismissed a request for retrial of a JPO decision upholding refusal. Although the original decision had not yet become final when retrial was requested, it had become final by the time the decision dismissing that request was issued. The defect arising from the original decision's lack of finality at the time of the request had therefore been cured by the time the dismissal decision was issued.
⇒ The request for retrial could not be dismissed on that ground.
The JPO decision was set aside.
