Osaka District Court, Reiwa 6 (Wa) 6216 [Taxi dispatch management system] <Judge Matsuami>
* Claim elements not satisfied.
⇒ New grounds of attack asserted after the court disclosed its preliminary assessment were rejected as untimely.
(Excerpt from the judgment, translated)
“Assuming that ‘taxi selection range information’ has been transmitted before reaching configuration ③ in the defendant's product, what is shown on the user terminal at configuration ③ is a ‘screen for selecting conditions,’ not information on individual vehicles. The defendant's product therefore does not satisfy claim element B3.
Furthermore, the defendant's product has no configuration for requesting dispatch of a particular taxi selected by the user. It therefore also lacks the ‘dispatch confirmation request’ in claim element B4.”
