IP High Court, Reiwa 6 (Gyo-Ke) 10035 [Gaming machine] <Presiding Judge Honda>

The invention is characterized by providing, in an “image displacement effect” where an image moves, a “normal mode” without vibration and a “special mode” with vibration and a higher jackpot probability.

⇒ The JPO found it readily conceivable by combining the cited invention (Ko 1: an image displacement effect with first and second effect modes having different probabilities) and the technical matters in Ko 2 (a technology in which an operation button vibrates together with a stereoscopic display effect during high-expectation events such as “super reach”).

The plaintiff argued that the cited invention's “image displacement effect” and Ko 2's “stereoscopic display effect” differ in methods and effects, and there was no motivation to combine them.

⇒ The judgment held: “The effects can be said to be common in that an image appearing different from the reference image is displayed, and it cannot be said that there is no motivation to combine them.” It also held: “Applying vibrating means to produce effects including vibration in the gaming machine of the cited invention is merely a matter that would naturally be carried out.”

⇒ No inventive step.
