Tokyo District Court, Reiwa 5 (Wa) 70393 [Foldable and stowable temporary protective fence] <Presiding Judge Nakashima>
“Rotating plate-like member” was not satisfied.
The specification refers to a thin plate and to making the overall width thinner and more compact through it. Accordingly, the term literally means a thin plate-like object and does not include round or square tubes.
⇒ The defendant's rotating support post is a square tube, so literal infringement was not established.
(The doctrine of equivalents also did not apply.)
